‘Diamond Ticket’ Prize Draw Promotion – Terms & Conditions

Promoter: Ecotricity Group Limited, Lion House, Rowcroft, Stroud, Gloucestershire, England, GL5 3BY (“we”, “us”)

The Terms & Conditions below govern the ‘Diamond Ticket’ promotion under which customers who make purchases of “Manifesto: How a Maverick Entrepreneur Took on British Energy and Won” (Manifesto) by Dale Vince will have an opportunity to win 1 of 10 ‘Diamond Tickets’ (the Prize Draw).

  1. Eligibility

    1. The Prize Draw is only open to residents of Great Britain aged 18 or over. The following are not eligible to participate in the Prize Draw:
      1. residents of Northern Ireland; and
      2. employees or agents of the Promoter or any of its subsidiaries and their family members.
    2. By participating in the Prize Draw, you confirm that you are eligible to do so and able to claim the Prize in accordance with these terms and conditions. We may require you to provide proof that you are eligible to participate in the Prize Draw.
    3. Participation in this Prize Draw will require access to the internet and an email address.
    4. There is a limit of one entry per person. Entries on behalf of another person will not be accepted, and joint submissions are not allowed.
    5. We may disqualify you at any stage of the Prize Draw if we reasonably determine that you have sought to gain an unfair advantage, have or are intending to damage the Promoter’s reputation or that you are engaged in fraud or theft.
    6. The Promoter’s decision on all matters relating to the Prize Draw is final.
  2. How to participate in the Prize Draw

    1. The Prize Draw is free to enter, however, you must have purchased a new copy of Manifesto from an authorised distributor..
    2. By submitting a Prize Draw entry, you are agreeing to be bound by these terms and conditions.
    3. The Prize Draw will run from 12pm (GMT) on 20th November 2020 (the Opening Date) to 23:59 (GMT) on 31 December 2020 (the Closing Date) inclusive.
    4. All Prize Draw entries must be made before the Closing Date. Any entries received after the Closing Date are automatically disqualified.
    5. To enter the Prize Draw, you must purchase a new copy of Manifesto direct from an authorised distributor and submit an entry by emailing your proof of purchase to us. Your entry must include, as a minimum:
    6. clear proof of purchase which includes the title of the book either in the form of a digital copy of a till receipt, or an e-receipt;
      1. your full name and town, city or county; and
      2. your email address and contact phone number.
    7. If you pre-order and pay for a new copy of Manifesto before the Opening Date, you may still enter the Prize Draw by submitting your proof of purchase in accordance with these terms.
    8. We will not accept:
      1. incomplete entries which do not include the information required under clause 2.5;
      2. responsibility for entries that are lost or not delivered properly, regardless of cause, including, for example, as a result of technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      3. proof of transmission as proof of receipt of entry to the Prize Draw.
  3. Winner selection

    1. Prize Draw winners (the Winners) will be drawn at random by Dale Vince Between 3-4pm on Wednesday 13th January 2021 and the prize draw will be live streamed on Dale Vince’s facebook page.
    2. The full names and counties of the Winners will be announced on the live stream of the prize draw. By entering this Prize Draw you accept that your details will be shared in this way. If for any reason you object to this, please let us know by contacting us on manifesto@ecotricity.co.uk and we will ensure that your name is removed from the list of entries. However, you acknowledge that by doing so, you forfeit your chance to enter the Prize Draw.
    3. The Winner selection will be carried out in the presence of an independent person appointed by us. The result of the draw is final and no discussions will be entered into regarding the results of the Prize Draw.
    4. Once selected, the Winners will be notified by email and invited to claim their Prizes by responding to the email. After the Winners have claimed their Prizes, we will endeavour to deliver the ‘Diamond Ticket’ within 30 days.
    5. If a Winner has been notified in accordance with clause 2.18 and does not claim their prize within 30 days of notification despite all of our reasonable efforts to contact them, the Winner will forfeit their Prize and the Prize will instead be allocated to a Substitute Winner, selected at the same time as the Winners. Substitute Winners will not be notified that they are on standby.
  4. The Prize

    1. The prize is one ‘Diamond Ticket’, which shall entitle the Winner to:
      1. an invitation to a tour of the Skydiamond Factory in Stroud, Gloucestershire in July 2021 for the Winner plus one guest (the Tour) (no replacement tours will be offered); and
      2. one, round cut manufactured ‘Sky Diamond’ of approximately 1 carat manufactured by the Promoter (the Skydiamond)(the Prize).
    2. 10 (ten) Prizes will be awarded in total.
    3. The Prize is non-transferable and no alternative prize will be given. If, for reasons outside of our control, we are unable to provide the Prize (or any part of it), we will, at our discretion, alter or substitute it for a different prize of equal or greater value than the original Prize.
    4. The Skydiamond is not a mined diamond and is subject to a lengthy manufacturing process. Winners will be provided with their personal Skydiamond once production is complete, currently estimated to be by June 2021. If this date will be delayed for any reason we will contact the Winners and let them know. If and once available, Winners will have the option of receiving their Skydiamond during the Tour or for it to be delivered to them.
    5. The Skydiamond will be provided unset and on an ‘as is’ basis. Colour and clarity rating of the Skydiamonds will be at the Promoter’s discretion. We shall use all reasonable endeavours to ensure that Skydiamonds awarded are as similar as possible, but the nature of the Skydiamonds is such that some variation is inevitable. We will not enter into discussions regarding the size, quality or other attribute of the Skydiamonds.
    6. Further details of the Tour, including the specific date and timings, will be communicated to the Winners at least two weeks before the scheduled date of the Tour. This will include a designated location in Stroud from which we will arrange to collect the Winners and their guests and transport them to and from the Skydiamond Factory for the Tour. We will reimburse pre-authorised standard class travel expenses (rail, coach or car) for travel to and from the Winners’ residence in mainland Great Britain to Stroud for the Tour. We will not reimburse any other out-of-pocket expenses We may require Winners to provide receipts to verify travel expenses. Overnight accommodation and meal vouchers will be provided if required.
    7. We reserve the right to change the date of the Tour at any time if we are unable to offer the Tour on the specified date. In such circumstances we will endeavour to select an alternative date as soon as reasonably possible after the original date on which all Winners are able to receive the Tour.
    8. The Tour is in a working factory and so may not be suitable for those with restricted mobility or other disabilities. If a Winner (or their guest) has any disabilities that may affect their ability to safely participate in the Tour, they should notify us as soon as possible so that we can make any reasonable adjustments necessary to enable the Winner and/or their guest to attend the Tour. If we are unable to provide safe or suitable access for a Winner we will be under no obligation to provide a replacement Tour. If the Winner is able to attend the Tour but their guest is unable to in the circumstances described above, the Winner will be entitled to select an alternative guest.
    9. If we reasonably determine that a Winner’s attendance at the Tour (or that of a guest) would give rise to a health and safety risk to themselves, factory staff or other Winners, we may refuse the Winner and their guest access to the Tour. In such cases we will be under no obligation to provide a replacement Tour.
  5. Announcement of Winners

    1. During and after the live draw, we will publicly announce the Winners’ names and place of residences (but not addresses) generally including on the social media channels of the Promoter and Dale Vince.
    2. You consent to the Promoter using your name and place of residence to publicise that you are a Winner. If for any reason you object to this, please let us know by contacting us at manifesto@ecotricity.co.uk and we would be happy to discuss the best way to achieve this without compromising your privacy.
  6. Liability

    1. Except for liability for death, personal injury or fraud, neither the Promoter, its employees nor their agents assume any responsibility for any fault, error, malfunction, damage, loss or disappointment suffered by the participants in the Prize Draw, howsoever arising from participating in the Prize Draw.
    2. Nothing in these terms and conditions affects your statutory rights.
  7. Other rules

    1. The Promoter’s decision as to whether an entry to the Prize Draw is valid is final.
    2. The Promoter reserves the right to modify these terms and conditions in response to events that are outside of its reasonable control
    3. By participating in the Prize Draw you agree to the use of your personal data by the Promoter for the purposes of administration of the Prize Draw and any other purposes to which you have consented. Please see our Privacy Notice for more details.
    4. The Prize Draw and the Terms and Conditions are governed by English Law and are subject to the exclusive jurisdiction of the English Courts.
